GC dataBay, Inc. grants a non-exclusive, non-transferable “AS-IS” license to use the specified quantity of each of the supplied products (“Products”) for the license term subject to the following terms and conditions. Title to the Products, and all patent, copyright, trade secret, trademark, and other proprietary rights relating to the Products, are and shall remain the exclusive property of the provider, GC dataBay, Inc. Client has no right to the Products except as expressly granted in the License Rights stated at time of purchase. Client shall be responsible for the installation and backup of any Products and for determining the compatibility of the Products with Client’s equipment, and software. Client may not, without prior written consent, modify, adapt, translate, or create derivative works of any of the Products. Any customization made to the program will prohibit normal upgrades to the system. Client may not, without prior written consent, sublicense, lease, rent, distribute or otherwise transfer any of the Products. GC dataBay, Inc. and its subsidiaries disclaim all warranties, expressed and implied, including but not limited to, warranties of merchantability and fitness for a particular purpose. GC dataBay, Inc. provides the products “AS IS” without warranty of any kind. In no event shall GC dataBay, Inc. be liable for any loss of profits, loss of saving, loss of business, loss of use or data, interruption of business, or for any other indirect, special, incidental, or consequential damages of any kind. Client assumes the entire risk as to the results and performance of the Products.  GC dataBay, Inc. is not responsible for technical support of third party solutions integrated with the Product. Because our software is offered on a try before you buy basis, there is absolutely no refund once purchased; all sales are final.
